Proposed Rules

Session Law 2011-398 (Senate Bill 781) created requirements for agencies in the rule-making process, per G.S. 150B-19.1(c), which states:

(c) Each agency subject to this Article shall post on its website when the agency submits the notice of text for publication in accordance with G.S. 150B-21.2 all of the following:

  1. The text of a proposed rule
  2. An explanation of the proposed rule and the reason for the proposed rule
  3. The federal certification required by subsection (g) of this section
  4. Instructions on how and where to submit oral or written comments on the proposed rule
  5. Any fiscal note that has been prepared for the proposed rule

Procedure for Subjecting a Proposed Rule to Legislative Review

If an objection is not resolved prior to the adoption of the rule, a person may also submit written objections to the Rules Review Commission. If the commission receives written and signed objections, in accordance with G.S. 150B-21.3(b2), from 10 or more people clearly requesting review by the Legislature and the Rules Review Commission approves the rule, the rule will become effective as provided in G.S. 150B-21.3(b1).

The Rules Review Commission will receive written objections until 5 p.m. on the day following the day the commission approves the rule. The commission will receive those objections by mail, delivery service, hand delivery or fax. To receive notices regarding rules in Title 09A of the N.C. Administrative Code that are being adopted, amended, repealed or are open for public comment, request to be added to the Interested Parties mailing list.
